NEW PORT RICHEY, FL — A gamer playing Grand Theft Auto online with another Florida man overheard his opponent sexually assault a 15-year-old girl.
On June 28, Daniel Enrique Fabian, 18, told his videogame adversary that he was going to “smash” the 15-year-old victim, who had stopped by his house.
Fabian then stepped away from his PlayStation 4, but he forgot to turn off the unit’s microphone, allowing the other gamer to hear through his headset everything that was happening.
The young victim later told police that Fabian had covered her mouth with his hand and pushed her down on his bed.
According to an affidavit, the gamer heard the teen tell Fabian “no” and to stop four times, but he ignored the girl's pleas and allegedly had forced sexual intercourse with her before returning to the Grand Theft Auto game 15 minutes later.
A medical exam performed on the victim showed Fabian’s DNA on her thigh, supporting the claim that he raped her.
Fabian was arrested on November 21 and booked into the Land O' Lakes Detention Center, where he was charged with two counts of lewd and lascivious battery and sexual activity with a victim between the ages 12 and 15 years old.
Authorities said Fabian was busted for a similar incident around the same timeframe as the June 28 attack.
"He was arrested in June for another case involving a different 15-year-old girl, where he allegedly raped her in his home as well,” noted Pasco Sheriff's Office Spokesman Kevin Doll.
"I had no idea it was this close to us," said Fabian’s neighbor, Ed Holtzman. "Being a father, I just try to put myself in that same situation. It's heartbreaking."
